The Present General Conditions of Sale are established on the basis of the applicable legislation within the European Union and more particularly Directive 97/7/CE of May 20, 1997 of the European Parliament and the Council concerning the consumer protection as regards remote contracts as well as modified proposal for a Directive of the European Parliament and the Council relating to certain legal aspects of the electronic trade in the domestic market on September 1, 1999.

These General Conditions of Sale have vocation to apply to the greatest number of purchasers but could not in no case to prevail on imperative legislative provisions of the home country of the purchaser and in particular to the provisions relating to the consumer protection who would appear contrary with certain provisions of present. In this case, only the provision of present which would appear contrary would be drawn aside, the remainder of the Conditions General of Sale remaining applicable. For purposes of applications of these General Conditions of Sale, it is necessary to understand by consumer any individual who acts at ends which do not enter within the framework of its professional activity.

1 - Order : Any order placed by the customer carries his general acceptance of these general conditions of sale which govern any sale by the company Be Zu du Monde S.A.R.L on the site http://www.bezudumonde.com.

The sold articles are described and presented on the Internet site with greatest exactitude. The photographs and graphics appear only as an indication and in order to help the customer in his choice. If errors were to appear, the responsibility for Be Zu du Monde S.A.R.L could not in no case to be committed of this fact.

The customer will place his order in accordance with the specifications being reproduced on the site. Any indication transmitted for this reason in particular as for its quality " of company, craftsman or liberal profession " or of " private individual " will be it under his responsibility.

The command validated by the customer will engage it and become final with reception of the acceptance of command by electronic mail on behalf of Be Zu du Monde S.A.R.L which reserves the right to refuse to deliver in certain countries.

2 - Price

The prices of the products are those in force at the time of the validation by the customer of the command and of which it will have been fully informed beforehand. These prices are expressed all inclusive of tax in consideration of the elements transmitted by the customer in particular as for the address of delivery.

3 - Transport Delivery

The transport, forwarding costs and delivery are the responsibility of the customer and are before indicated the validation of the command at the time of the indication of the price of the controlled products. The controlled products will be delivered to the customer with the address indicated by him before the validation of its command. The delivery will be attested by the signature, by the customer, of the delivery order.

Be Zu du Monde S.A.R.L is committed delivering the products within the time indicated before validation of the command. These deadlines take account in particular of the nature of the product to deliver (certain products being manufactured on command), of stocks and the place of delivery. Be Zu du Monde S.A.R.L is committed, on the assumption that it would have no possibility to deliver within the time agreed upon with the customer, to inform by electronic mail this last as soon as possible and communicating the new delivery time of it to him. Except case of absolute necessity, the customer will be then free, either to accept the new time communicated by Be Zu du Monde S.A.R.L, or to ask the resolution of the sale and for the refunding of the entirety of the paid price. With defect, on behalf of the customer, acceptance clearly expressed by electronic mail within seventy two (72) hours of the new delivery time, the sale will be automatically solved. In the case of resolution of the sale, Be Zu du Monde S.A.R.L will inform the customer by electronic mail of it and will refund to him the entirety of the price paid within fifteen (15) day.

4 - Conformity

If, by exceptional, the delivered products were not in conformity in kind or quantity with the specifications indicated in the delivery order or had undergone damages during transport, the customer must make some clearly and lisiblement mention on the delivery form and will have to refuse the product which will be taken again by the deliveryman. The customer will have, in any event and hardly of forfeiture, to formulate his complaints near Be Zu du Monde S.A.R.L by electronic mail within eight (8) day from the delivery. Be Zu du Monde S.A.R.L will contact the customer then as soon as possible and will propose to him, with the choice of the customer who will have to be clearly expressed, either the full repayment of its command, or a new delivery of the products controlled without additional expenses. In the case of a refunding required by the customer, Be Zu du Monde S.A.R.L will refund the entirety of the price paid within fifteen (15) day from the request of the customer.

5 - Payment The products offered on the site http://www.bezudumonde.com are payable with the command in French Francs and Euros. The payment can carried out by cheque or by means of a system made safe by encoding.

6 - Faculty of retraction The customer consuming has deadline a seven (7) working days from the reception of his command to ask for the refunding of the controlled products. The request for refunding will have to be addressed within the time known indicated to Be Zu du Monde S.A.R.L by electronic mail with the following address: " infozu@bezudumonde.com ". On this assumption, the conveyor of Be Zu du Monde S.A.R.L will come on go to recover the products, or by direct sending by the customer. Be Zu du Monde S.A.R.L will refund the customer as soon as possible and, at most, within thirty (30) day. The expenses of return will remain however with the load of the Customer. For the products made on special command according to dimensions or colors or by means of materials not specified in the standard offer of the Manufacturer or carrying elements of identification of the customer, the faculty of retractation aforementioned will have to be exerted within seven (7) working day from the command.

7 - Assembly The controlled products will be delivered if it is necessary with a note of assembly including/understanding the instructions, at least in French and English language, necessary to the assembly of the controlled products. The customer will carry out the assembly under his only responsibility. In the event of difficulties, the customer will be able to contact by electronic mail Be Zu du Monde S.A.R.L which will make its possible in order to help the customer without any engagement of result of its share.

8 - Guarantees The market products profit from the legal guarantees against very vice hidden as well as possible specific guarantees of the manufacturer. Any return of product under these guarantees will have to be the subject of prior agreement of Be Zu du Monde S.A.R.L. 9 - Responsibility The customer will conform strictly to the instructions accompanying the market products, Be Zu du Monde S.A.R.L could not see its committed responsibility with some title that it is for all direct or indirect damage resulting from a misuse of the market products. In any event, Be Zu du Monde S.A.R.L could not see its committed responsibility with some title that it is for all consequential damages or expenses resulting from the use or impossibility of use of the market products.

10 - Right of access to the personal data The personal information collected by Be Zu du Monde S.A.R.L during the recording of the command will be stored by it. The customer profits from a right of access, of correction and opposition to information about him seven (7) working days from the command.

11 - Reserve property Be Zu du Monde S.A.R.L preserves the property full and whole market products until complete payment of the price, the main thing, expenses and taxes included. This reserve of property does not make however obstacle, as from the delivery, with the transfer to the customer of the risks of loss or deterioration of the goods as of the damage which it could cause.

12 - Attribution of jurisdiction Duty applicable of convention express, this contract is subjected to the provisions of the French right. With the exception of the consumers for whom the terms of legal reference apply, all difficulties of interpretation or execution of this contract, even after its termination, will be subjected, in the absence of friendly agreement, exclusively with the Court of Montpellier in France.
